RideRadar Terms of Service
The rules for using RideRadar, written to actually be read.
Read in another language: Italiano · English · Deutsch · Français · Slovenščina
These are the same terms you accept inside the app: the app and the website show the same text and are updated together.
1. Who we are and what you accept
RideRadar is an app for people who ride motorcycles: navigation, group rooms with voice, a ride diary, a Garage, a community feed, mountain pass cards and an RR Coin wallet. An assistant is also planned, but it is not active today (section 11). The service comprises the app and the website rideradar.it. The operator of the service is Giovanni Oliverio, an independent Italian developer (a natural person). You can write to us at assistenza@rideradar.it (section 17). By using RideRadar you accept these terms. If you do not accept them, do not use the app. These terms are a single text, the same in the app and on the website. You can read these terms and conclude the contract in Italian, English, German, French or Slovenian. How we handle your data is set out in a separate document, the Privacy Policy: these terms refer to it where needed.
2. Age, requirements and limits
The service is reserved for people aged 16 or over: by accepting these terms you declare that you have reached that age. The limit is our own choice, and it is the same in every country where the app is offered. If we find that an account belongs to someone under 16, we close it and delete its data. To have an account you need an email address (or Google sign-in), a username and the age declaration. Use of the app is not conditional on your consent to usage measurement or on any other optional consent: the Garage, photos, contributions on passes, voice, dictation and usage measurement are optional, and if you do not use them the rest of the app works all the same. Technical requirements: a phone running Android 7.0 or later, GPS and a data connection. Without GPS, navigation, ride recording and SOS do not work, and in a room the others cannot see you on the map. Current limits: a room holds up to 3 riders, and voice in rooms is capped at 30 minutes a day for each rider, which the app shows you. The service is free of charge: today RideRadar is in open trial, no feature is paid for and there are no in-app purchases.
3. Withdrawal and closing your account
Opening an account is a distance contract, even though you pay nothing. You have 14 days from the creation of the account to withdraw without giving any reason: write to assistenza@rideradar.it (you can use the form at the end of these terms) or delete the account from Settings > Delete account. Withdrawing costs you nothing. The contract is of indefinite duration: even after the 14 days you can end it whenever you want, by deleting the account. Withdrawing and deleting the account have the same effect: the account and the data are erased, as described in the Privacy Policy, in the section on your rights. We can suspend or close your account only in the cases set out in section 2 (age) and section 7 (violations).
4. Community rules
The feed, published rides, photos, comments, ratings and your profile are content that we store for you and show to others: the rules of this section and of the EU Digital Services Act (Regulation (EU) 2022/2065) apply to them. Voice in rooms is not stored and is not part of the hosted content. The rules apply to everything you share: voice rooms, comments, photos, ratings, published rides and your profile. You undertake:
- not to use offensive, hateful, harassing, defamatory or illegal language or content;
- not to publish other people's personal data without their consent; if a photo shows recognisable people or number plates, it is up to you to have their consent before publishing it;
- not to publish content that infringes copyright or other third-party rights;
- not to spam or send unsolicited advertising;
- not to tamper with the coin-earning mechanisms (section 10).
Terrorist content is prohibited and is removed. In Switzerland the law punishes anyone who reports police checks or speed cameras, in public or by phone: do not do it in the feed, in comments or in voice rooms. Such reports are removed.
5. Voice rooms: recording and distribution prohibited
Voice in rooms is live: it is not recorded or kept by us, it simply passes through. The room is a private conversation between the riders who are part of it. In voice rooms it is forbidden to record, save or distribute the voice of the other members without the explicit consent of everyone, whether with the app or by any other means, even during an SOS: those taking part have not consented to being recorded. In Germany, Switzerland and France, recording other people's voices without their consent is a criminal offence, and so is keeping or passing around a recording made in that way; in Austria it is a criminal offence to play the recording to others or to publish it. Everywhere, distributing other people's voices without their consent violates these terms and may expose you to civil and criminal liability. Anyone who does so is excluded from the service.
In voice rooms we do not listen to anyone and we do not record anyone: the voice passes through our servers live and nothing more, as the Privacy Notice says. That is precisely why what you say out loud is your responsibility: in some countries, Switzerland first among them, warning others about the presence of speed checks is prohibited by law, and anyone who does it in a room answers for it personally. We do not listen in and we do not monitor what is said; but if we learn that someone is doing it, we can close their access to the rooms.
6. Reporting, muting, blocking
You can report a ride, a pass photo, a comment or a profile from the app, choosing a reason, or by writing to assistenza@rideradar.it. Inside a room you can report a rider from their row in the list. For a report of illegal content to be complete, state: where the content is, why you consider it illegal, and confirm that you are saying so in good faith. If you report by email you can leave your name and email address (not required for reports of child sexual abuse): if you leave them, we confirm receipt. Reports are read by a person; those about illegal content take priority, and illegal content is removed without delay, as soon as we become aware of it. We notify you of the decision at your account email address or at the one you left us, stating whether we used automated tools and how to challenge it. In the app you also find the tools to stop seeing a rider's rides, to hide their comments on passes, to mute them inside a room and to block them. Blocking is mutual: you no longer see each other in the feed, on profiles, in search or under comments; you can no longer follow each other, or comment on or rate each other's rides; you no longer receive notifications from each other. You can remove it whenever you want from Settings > Blocked riders. Inside a room that is already under way it throws nobody out: it takes effect once one of you leaves, and from then on neither of you can join a room where the other is.
7. How we check, and what happens to those who break the rules
We have no obligation of prior monitoring and we do not look inside photographs with automated systems: no face or number-plate recognition. Before publication, an automatic filter compares the text you write (ride titles and descriptions, comments, username and profile) against a list of words that attack a person for who they are: if it finds one, the text is not published and we tell you. The filter knows only Italian and does not read context. Everything else is published immediately and is checked by a person, on the basis of reports. If a text of yours is stopped, you can write to assistenza@rideradar.it and a person will read it again. When you save a ride, the server checks that it is real: a simulated location, impossible jumps or kilometres incompatible with the time are recorded as anomaly flags and end up in a list that a person checks; a ride with a simulated location is not credited. Today no penalty is triggered automatically. Violations lead to removal of the content, reduced visibility, resetting of coins to zero, suspension or closure of the account. These decisions are taken by a person, not by an automated process. We may suspend or close an account in the event of a violation of these terms, abuse of the safety features, illegal content or behaviour that harms other users or the service. If we switch on automatic penalties, we will update these terms first. If we remove content of yours, reduce its visibility or restrict your account, we write to you at your account email address, no later than the day of the measure: what we did, for how long and in which countries; on the basis of which facts, and whether it stems from a report by another user; whether an automated check played a part; which rule of these terms or which legal provision is violated and why; how to challenge the decision. We do not do so if the measure carries out an order from an authority that forbids us to. You can ask for a review by writing to assistenza@rideradar.it: a person re-examines the decision from scratch. This is our own choice, beyond what the law requires of a service of our size. You always retain the right to go to the courts of the place where you live.
8. Riding safety and SOS
Your personal safety and safety on the road come before any feature of the app. RideRadar is an information aid. Set up your route, room and audio before you set off. While riding, do not touch the screen: interact with the app only when the vehicle is stationary and in safe conditions. Voice dictation reduces the number of taps needed, but it still requires a tap to activate: it is not a hands-free control. Mount your phone on a suitable holder that does not obstruct your view of the road or get in the way of the controls. At all times you remain solely responsible for how you ride, for complying with the road traffic rules of the country you are in and for assessing the actual conditions (traffic, weather, road surface, closed roads). Road signs always take precedence over the app. Routes and journey times are calculated by our engine on OpenStreetMap data; maps, weather, place search and points of interest come from third-party providers and open projects. All of this is provided without any guarantee of accuracy or currency: a suggested route may be impassable, closed or prohibited. Crash detection and the SOS feature work as well as the phone allows and depend on sensors, battery, network coverage and the state of the device: we do not guarantee that an accident will be detected or that an alert will be sent or received, and they are no substitute for the emergency numbers. SOS is not a medical device: it does not diagnose, it does not measure or monitor bodily parameters, it does not assess your state of health. It detects an impact from the phone's sensors and sends your location to the riders in the room you are in, and only to them: if you are not in a room, the SOS is not sent, and the phone tells you so. The room and SOS are not a rescue service. In an emergency, always call 112. The medical details you can fill in stay on your phone only: after an SOS they open by themselves on the screen, read-only, so that whoever comes to your aid can read them from your phone, and they close by holding the screen down for five seconds. The phone's lock screen stays in place: if the phone is locked, or if another app is in front, the details are not visible until someone brings RideRadar back to the front. From the details you can open the phone's dialler with 112 already entered: the call is made by the person, the app does not call by itself and does not ask for permission to call.
9. Speed camera alerts, country by country
Speed camera reports come from the database of a specialist provider; the app does not collect reports from riders. They are for information only and may be incomplete, inaccurate, out of date or entirely missing across whole areas: the absence of an alert does not mean there are no checks, and no feature of the app entitles you to exceed the speed limits. It is your responsibility to check that using or reporting speed camera alerts is lawful in the country where you ride. Today the alert is active in Italy, Austria and Slovenia; where the law prohibits it (today Germany, Switzerland and France), and when the app does not recognise the country you are in, the feature is switched off and must not be circumvented. In France, under the French road traffic code, anyone who possesses, carries or uses a device that signals the presence or location of speed cameras risks a fine, the loss of 6 licence points, suspension of their driving licence for up to 3 years and confiscation. On French territory RideRadar's alert is switched off: there, RideRadar is not a speed camera warning device and provides neither danger zones nor distance alerts. In Switzerland, under the Federal Act on Road Traffic, using a device or an app that warns of checks, and reporting them to others, are offences punishable by a fine and, in serious cases, by a monetary penalty. In Switzerland RideRadar's alert is switched off. Today RideRadar is free: speed camera alerts, like every other feature, are not paid for.
10. Virtual currency (RR Coin)
RR Coins are an internal game currency. They are earned only inside the app: with real rides recorded by the app and with the daily login. They have no monetary value, cannot be converted into money, cannot be bought and cannot be exchanged between users. Today in the Wallet you see your balance, your level, your login streak and your activity. There is nowhere yet to spend the coins: the screen announces them as coming soon. When rewards arrive, we will update these terms and the Privacy Policy first; they will be subject to availability and to the partners' conditions, and the catalogue, the costs in coins and the earning mechanisms may change. RR Coins may be reset to zero in the event of abuse or fraud in the earning mechanisms (section 7) and are lost when the account is closed, including when the closure is due to a violation, without any refund or compensation. Today none of your personal data is shared with partners.
11. Rider Assistant (artificial intelligence)
The app contains a Rider Assistant that is not active today: it does not appear in the menu and the server does not accept questions from any account. When we activate it, we will update these terms and the Privacy Policy first. This already applies now: the Rider Assistant is an artificial intelligence system, not a person. The replies come from a language model supplied by Anthropic, and its answers may be wrong. It offers trip ideas, route suggestions, weather and trivia. Advice on maintenance, mechanics or motorcycle technology is not professional advice or the opinion of a mechanic: any work on the vehicle or decision taken on the basis of the answers remains at your own risk. In Switzerland do not ask it where the police checks are (section 4). What Anthropic receives when you use it is set out in the Privacy Policy, in the section on providers.
12. User content and licence
The content you publish remains yours. By publishing content (rides, photos, comments, ratings) you declare that you hold the rights to it and you grant the operator a non-exclusive, royalty-free, worldwide licence, limited to hosting, displaying and distributing it within the service, for as long as the content remains published. The licence ends on removal, except for the time the content remains in the database backups (7 days). Voice in rooms is neither hosted nor stored: the licence is limited to its live transmission to the other members of the room. A ride you publish also has a page on the website rideradar.it, readable by anyone who has the link, even without an account. It shows the ride's title and description, your username, the bike on your profile, the name of the starting place, the publication date, the kilometres, the duration, the ascent, the hairpins and the track with the start and finish trimmed; it does not show speeds. The link is obtained from the share button, which anyone who sees your ride in the feed also has. If you delete the ride, the page disappears. You are solely responsible for what you publish and, to the extent permitted by law, you undertake to hold the operator harmless against third-party claims arising from your content or your conduct. We may remove content that violates these terms or the law, in accordance with section 7, without any obligation of prior monitoring.
13. Changes to the service and to these terms
We may modify, suspend or discontinue features or the entire service for technical, security, provider-cost (maps, audio, databases) or legal reasons, at no additional cost to you. If a change significantly reduces what you can do, we tell you in the app with advance notice, and you can close your account whenever you want. Today all features are free. If in future we introduce paid features, features that were free will not become chargeable for the use you have already made of them. We may update these terms to adapt them to new features, to changes in providers or to legal requirements. We notify you of material changes in the app with at least 30 days' notice; silence does not count as acceptance. If you do not accept them you can close your account at any time (Settings > Delete account). In France a prefect may order a navigation service to suspend, for an area and for a few hours, the rebroadcasting of users' messages: if we receive such an order we may restrict or suspend the feed and rooms in the area and for the period indicated (and, until the app can do this by area, for the whole of France too) without notice and without having to give the reason. The contact address for these communications is assistenza@rideradar.it.
14. Warranties and limitation of liability
The service is offered free of charge and “as is”, without prejudice to the conformity rights the law grants you as a consumer (in Italy, the Consumer Code): we do not guarantee continuity, absence of errors or availability of individual features, which also depend on third-party providers. Riding decisions remain yours: the road traffic offences you commit, the penalties and the licence points are your responsibility. To the extent permitted by law, the operator is not liable for indirect damage, loss of data or loss of profit. Nothing in these terms excludes or limits our liability for wilful misconduct or gross negligence, for death or injury to life, body or health caused by our act or omission, even if merely negligent, nor the mandatory rights the law of your country grants you as a consumer.
15. Intellectual property
The RideRadar trade mark, the logo, the software and the content of the app and the website belong to the operator or to their respective licensors. The photographs of mountain passes come from Wikimedia Commons and are used under the licence of each one (Creative Commons or public domain), with the author and licence shown in the app. The maps come from Mapbox; place search and routes are based on OpenStreetMap data, with the attribution shown in the app. The app is licensed for personal, non-commercial use: no other right is transferred to you. You may not copy, modify, decompile or resell the app, except where the law allows it.
16. Governing law, jurisdiction, complaints and ADR
These terms are governed by Italian law. If you are a consumer, the choice of Italian law does not deprive you of the mandatory protections of the law of the country where you reside: for Austria, in particular, the Consumer Protection Act (KSchG) and the Act on distance contracts (FAGG); for Germany the rules of the German Civil Code (BGB) on general terms and conditions; for France and Slovenia the respective consumer codes. If you are a consumer, the courts of the place where you reside or are domiciled have jurisdiction, and by law this cannot be waived; in all other cases the courts of the place where the operator resides have exclusive jurisdiction. If something goes wrong, write to us first at assistenza@rideradar.it: we will try to sort it out. We are not a member of any alternative dispute resolution (ADR) body. If a written complaint of yours is not resolved, we tell you in writing which ADR bodies are competent in your country and whether we intend to take part. You may in any case submit a request on your own to an ADR body in your State; the procedure also requires our participation, which is not compulsory and which we confirm to you in writing case by case. The European Commission's official list is at consumer-redress.ec.europa.eu/dispute-resolution-bodies. You always retain the right to go to the courts of the place where you live.
17. Contact
Service operator: Giovanni Oliverio, independent developer. Email: assistenza@rideradar.it. Business activity: development and operation of the RideRadar app and the website rideradar.it. For any communication, support request, report or complaint, write to assistenza@rideradar.it: a person replies, not an automated system. Single point of contact under the EU Digital Services Act (Regulation (EU) 2022/2065, Articles 11 and 12), for authorities and for users, and point of contact for removal orders concerning terrorist content (Regulation (EU) 2021/784, Article 15): assistenza@rideradar.it. Languages: Italian and English. You can also report a technical problem with the app from Menu > Report a problem.
18. Languages and final clause
These terms are published in Italian, English, German, French and Slovenian: each version is written to be understood on its own. In the event of a discrepancy between the versions, the version in the language in which you accepted prevails. If any provision of these terms proves invalid or unenforceable, the others remain fully effective. These terms replace every previous version published in the app or on the website.
